Types of Cases Heard at Willoughby Municipal Court

Willoughby Municipal Court tries all misdemeanors, ordinance violations, and traffic violations within its jurisdiction. It also tries civil matters involving $15,000 or less, and small claim complaints involving $6,000 or less.

Traffic Violations

Traffic violations are not criminal matters, but they can still incur penalties that you may wish to mitigate. Unpaid fines from a traffic conviction can complicate your financial and legal situation, and accruing too many points against your driving record can lead to a license suspension.

It’s important to have experienced legal support to guide you through the process of fighting an unfair ticket and seeking a better outcome. Let Patituce & Associates help you in these matters.

Misdemeanors

A misdemeanor is considered a less serious crime, but many misdemeanors can incur penalties that include jail for up to a year, as well as punishing fines. If you face unfair accusations, it’s important to have experienced legal counsel represent you and defend your rights. It may be possible to mitigate or even beat your charges.

Felonies

Although Willoughby Municipal Court doesn’t try felony cases, it conducts felony preliminary hearings. These proceedings are intended to determine if there’s probable cause to hold a defendant and refer their case to the Lake County Common Pleas Court for further adjudication.

Recent Case Results

Achieving favorable results for a client can mean several things, depending on the circumstances at hand. While the best possible outcomes are usually dropped charges or an acquittal, aggressive negotiation can also secure favorable results such as a reduced charges or reduced sentencing when much more serious penalties are otherwise on the line.

Take a look at a few case results we helped our clients achieve:

  • Case Dismissed: In Cleveland v. Al-Nazer, our client was charged with a DUI and later accused of wrongfully handling a firearm. We successfully argued that the trooper engaged in improper conduct and other violations that resulted in a case dismissal.
  • Charges Dismissed: In the State v. Bittner, Lorain County, our client was caught selling drugs and charged with drug trafficking. Our advocacy helped them to avoid the worst possible penalties by entering into a first-offender program.
  • Evidence Suppressed, State Lost the Appeal: In the City of Cleveland v. Oles, our client was stopped for an allegedly illegal lane change and arrested for driving under the influence. We believed the trooper used improper investigative techniques that violated our client’s rights, and won at trial.
  • OVI Charges Dismissed: in the City of Oberlin v. Barber, our client was stopped for speeding. The investigating officer unexpectedly requested our client perform a field sobriety test and a breath test, then the officer arrested our client for DUI/OVI. We successfully argued that the trial court should dismiss all charges, and it eventually agreed to drop all but the speeding charge.
  • Reduced Penalties: In the U.S. v. Poling, our client faced federal child pornography charges. A conviction for this offense usually carries a minimum of 10 years in prison, however we helped our client receive a favorable five-year sentence.

The worst possible outcome to your criminal charges isn’t inevitable. Patituce & Associates can provide the legal support you need to avoid unfair treatment and protect your rights.
