The Parma Municipal Court is part of Ohio's municipal court system, which handles cases that involve less severe offenses than those heard by the county Common Pleas Courts. Unlike Common Pleas Courts, which deal primarily with felonies, the Parma Municipal Court handles misdemeanor offenses, traffic violations, small civil disputes (under $15,000), and other local matters.
The court’s jurisdiction is limited to Parma and the surrounding cities, and it cannot hear cases involving felonies or major civil disputes. However, people facing felony charges will initially be processed at this court before being transferred to the Cuyahoga County Common Pleas Court.
Award-Winning Firm
Types of Cases Heard at the Parma Municipal Court
The Parma Municipal Court has jurisdiction over various local matters, including criminal misdemeanors and traffic violations. Some of the cases heard at this court include:
- Misdemeanors: The court handles all misdemeanor criminal offenses, which are defined generally by Ohio law as any offense that carries less than one year in jail. Examples include certain theft crimes, drug crimes, disorderly conduct, domestic violence, and assault.
- DUI/OVI: The court also processes DUI / OVI cases. These serious traffic offenses can result in license suspensions, jail time, fines, and other penalties that may affect your ability to drive and your record for years to come.
- Traffic Violations: Parma Municipal Court processes traffic-related offenses, including speeding, reckless driving, driving without a license, and DUI/OVI charges. Convictions for these offenses can result in fines, license suspensions, and jail time.
- Arraignments: Arraignments in Parma Municipal Court are typically held daily. During arraignments, defendants are formally charged, advised of their rights, and given the opportunity to enter a plea. Bail may also be set depending on the severity of the charge.
- Pre-trial Hearings: In pre-trial hearings, both the defense and prosecution present evidence, file motions, and attempt to resolve the case without going to trial. These hearings are essential to determining the direction of the case, and a strong defense can make all the difference.
- Probation (Community Control): The court oversees probation for misdemeanor offenses as an alternative to incarceration. Defendants may serve probation within the community under specific conditions, including regular reporting to a probation officer, avoiding further legal trouble, and adhering to court-imposed requirements.
