Types of Cases Heard at the Sandusky Municipal Court

The Sandusky Municipal Court is part of Ohio’s municipal court system, which handles misdemeanor criminal cases, traffic violations, and civil matters with smaller claims. Unlike the Common Pleas Court, which has jurisdiction over felonies and larger civil disputes, the Sandusky Municipal Court focuses on local-level cases such as first-time DUI/OVI offenses, minor theft, and other misdemeanor offenses. According to the Court’s Annual Report, it hears more than 6,000 criminal cases every year.

Some of the cases heard at this court include:

  • Misdemeanors: The court handles all misdemeanor criminal offenses, which are punishable by up to one year in jail and/or a fine of up to $1,000. Examples of misdemeanor cases include petty theft, disorderly conduct, domestic violence, various drug crimes, property crimes like criminal mischief, and assault.
  • DUI/OVI: The Sandusky Municipal Court also oversees DUI /OVI cases, which can result in severe penalties such as license suspension, fines, and potential jail time. The Court handles an average of 400+ OVI cases each year involving all types of aggravating factors, including breath test refusals, child endangerment, and prior convictions.
  • Traffic Violations: The court processes traffic offenses such as speeding, reckless driving, and driving without a license. These offenses can lead to fines, points on your license, or even jail time for more severe violations.
  • Arraignments: Arraignments are a key step in the legal process, where defendants are formally charged and informed of their rights. Defendants may enter a plea, and bail is set based on the seriousness of the offense.
  • Pre-trial Hearings: During pre-trial hearings, the defense and prosecution present evidence, file motions, and may negotiate plea deals. These hearings are essential in determining the direction of the case.
  • Probation (Community Control): Probation, also known as Community Control, is often used as an alternative to jail time for misdemeanor offenses. The court may impose specific conditions, including regular meetings with a probation officer or participation in treatment programs. In addition to supervising offenders on diversion, electronic monitoring, and probation, the Sandusky Municipal Court’s Probation Department also completes presentence investigations, collects restitution and provides drug testing for the Court.

Recent Results:

Our attorneys have achieved successful outcomes in numerous cases at the Sandusky Municipal Court and other state and federal courthouses in Ohio. Some of our recent results include:

  • CASE DISMISSED: DUI/OVI: Our client was charged with a DUI after failing a breathalyzer test. We successfully challenged the validity of the test, leading to the dismissal of the case.
  • NOT GUILTY: Domestic Violence: Our client faced domestic violence charges, but we demonstrated inconsistencies in the prosecution’s case and secured a not-guilty verdict.
  • REDUCED CHARGES: Drug Possession: Our client was charged with misdemeanor drug possession, but we negotiated a plea deal that reduced the charges to avoid jail time and a permanent record.
  • OVI CHARGES DISMISSED: DUI/OVI: Our client was pulled over for speeding and unexpectedly asked to perform a breath test and field sobriety tests. We defended our client at the trial court, which ultimately agreed that all evidence should be suppressed, and the OVI/DUI charges dropped.
  • REDUCED CHARGES: Drug Possession: Our client was charged with misdemeanor drug possession. After negotiating with the prosecution, we were able to reduce the charges, allowing our client to avoid jail time and a permanent record.
