Aggravated Assault Defense in Cleveland

The State’s Theory Shapes Your Aggravated Assault Defense

An aggravated assault accusation requires close attention to the State’s specific theory. The case may involve alleged serious physical harm, an attempt to cause physical harm with a weapon, or an object prosecutors claim qualifies as dangerous ordnance. The language of the complaint or indictment, along with the evidence supporting each element, can shape the defense from the start.

We represent people facing felony investigations and charges in Cleveland and Cuyahoga County. Our involvement can begin before charges are filed and continue through motions, negotiations, trial, sentencing, or appropriate post-conviction proceedings.

What Ohio Law Defines as Aggravated Assault

Ohio Revised Code Section 2903.12 applies when a person, while under the influence of sudden passion or a sudden fit of rage caused by serious provocation, knowingly causes serious physical harm or causes or attempts to cause physical harm with a deadly weapon or dangerous ordnance. The provocation must be reasonably sufficient to incite the use of deadly force. A deadly weapon is generally an instrument capable of causing death that is designed, adapted, possessed, carried, or used as a weapon.

Serious physical harm can include a substantial risk of death, temporary or permanent substantial incapacity, serious disfigurement, or prolonged or intractable pain. Aggravated assault is generally a fourth-degree felony. It can be a third-degree felony in specified cases involving a peace officer or an investigator with the Ohio Bureau of Criminal Investigation.

Aggravated Assault vs. Felonious Assault

Felonious assault is a separate offense under Ohio law. Its basic statutory definition doesn’t contain the same language concerning serious provocation, sudden passion, or a sudden fit of rage. Determining which offense the evidence supports requires an analysis of the accused person’s mental state, the timing of the alleged provocation, the claimed injury, and any weapon allegation.

What to Do After an Arrest or Accusation

Early decisions can affect what evidence remains available and which statements become part of the case. Before responding to investigators or discussing the incident with others, get legal advice based on your circumstances.

Steps to protect your ability to make informed decisions include:

  • Don’t answer questions about the incident or consent to an interview before consulting our defense attorneys.
  • Don’t post about the accusation, alleged victim, witnesses, or evidence on social media.
  • Preserve messages, photographs, videos, medical documents, location information, and witness contact details without changing or deleting anything.
  • Follow all bond conditions, protection orders, and court instructions.
  • Don’t contact an alleged victim if doing so could violate an order or interfere with the case.
