Felony Charges We Defend in Cleveland

Our felony practice includes drug crimes, federal crimes, sex crimes, theft crimes, violent crimes, white-collar crimes, and post-conviction matters. Each category can involve different evidence, procedures, and penalties, so we build the defense around the allegations rather than relying on a standard response.

Representation can begin before an arrest. During a pre-arrest investigation, we can evaluate law enforcement contact, advise a client before an interview, and identify the legal and factual issues that may shape the case.

How We Prepare a Felony Defense

We begin by reviewing the charge, available discovery, procedural history, and the client’s account. We then investigate the evidence and assess whether police searches, seizures, questioning, or identification procedures created grounds for a constitutional challenge.

A defense plan may involve:

  • Reviewing reports, recordings, physical evidence, and witness statements
  • Investigating conflicts, omissions, and weaknesses in the prosecution’s evidence
  • Filing appropriate motions and constitutional challenges
  • Conducting plea negotiations based on the facts and the client’s objectives
  • Preparing for a jury trial when trial is the appropriate course

Evaluating Plea Offers & Trial

Plea and trial decisions involve different risks and possible outcomes. As felony criminal defense attorneys in Cleveland, we assess the strength of the evidence, potential penalties, and the effect a conviction could have on the client’s record. We explain the available options so the client can make an informed decision.

Trial preparation doesn’t begin only after negotiations fail. Our courtroom experience shapes how we investigate the case, test the prosecution’s theory, and evaluate every plea offer from the outset.

How Felony Cases Move Through Cuyahoga County Courts

Under Ohio law, an offense is a felony when it may be punished by more than one year of imprisonment. An offense carrying no more than one year is a misdemeanor. This distinction determines which court has authority over the case. The Cuyahoga County Court of Common Pleas, General Division, has original jurisdiction over felony offenses. Municipal courts generally handle misdemeanors, including Cleveland Municipal Court.

Indictment, Preliminary Hearing & Bindover

A Cuyahoga County felony case may begin with charges filed by the Cuyahoga County Prosecutor’s Office or a grand jury indictment. An indictment is a formal accusation stating that probable cause exists to pursue the listed charges. It isn’t a finding of guilt.

When a case begins in municipal court, a preliminary hearing may be scheduled to determine whether probable cause supports the felony allegation. If the required standard is met, the case may be transferred, or bound over, to the Court of Common Pleas. The precise path depends on how the charges were initiated and what occurs before the hearing.
