Cleveland OVI Refusal Defense
Experienced Defense After an OVI Test Refusal
A refusal creates two immediate legal concerns: an Administrative License Suspension and a criminal OVI case that can proceed without test results. Patituce & Associates represents people accused of OVI after refusing a breath, blood, or urine test, addressing each part of the case on its own facts.
Joe Patituce has handled thousands of DUI and OVI cases across Ohio and is one of only eight board-certified criminal lawyers in the state. Our attorneys include former prosecutors who understand how the government builds these cases from officer observations, roadside sobriety exercises, video, and other evidence.
Call (440) 771-1175 for a free consultation about an OVI refusal arrest in Cleveland and the options for addressing your license suspension and defending the allegations.
We understand that your specific situation requires individualized attention, and we are dedicated to providing just that.

Evidence Review & BMV Hearing Representation
Refusing testing doesn’t prevent the state from pursuing an OVI case. Prosecutors can rely on driving behavior, statements, officer observations, roadside sobriety results, and dash camera video. A defense therefore requires close examination of what happened before the stop, during the investigation, and after the arrest.
In every DUI case we handle, we review police reports, field sobriety testing results, dash camera video, and the complete logs associated with any breath, blood, or urine testing. Depending on the disputed issues, we can retain toxicologists or accident reconstructionists as expert witnesses.
Challenging the ALS
We represent clients in BMV hearings and recommend requesting an ALS hearing promptly. Our firm states that failing to request a hearing within 30 days can put driving privileges at risk for six months or longer. The available arguments and deadlines depend on the arrest record, the notice provided, and how the refusal was documented.
An ALS challenge doesn’t replace the criminal defense. We evaluate the suspension procedure separately while examining whether the evidence supports the prosecution’s allegations beyond a reasonable doubt.
Cleveland OVI Court Procedure & ALS Appeals
Misdemeanor OVI arrests within Cleveland city limits or the Village of Bratenahl are arraigned in Cleveland Municipal Court. Felony OVI cases arising in Cleveland, including a fourth OVI within 10 years or a sixth lifetime OVI, are transferred to the Cuyahoga County Court of Common Pleas.
Ohio law generally requires an initial appearance within five days of the arrest or citation, although a continuance can affect that timing. The initial appearance is also when the Administrative License Suspension may be appealed, making early review of the citation, suspension notice, and court schedule important.
An Ohio appellate decision confirms that failure to hold the initial appearance within the required timeframe can void the ALS connected to that arrest. Whether the rule applies depends on the procedural history, including the reason for any delay. We examine those dates rather than assuming the criminal case and license suspension followed the same path.
