Cincinnati Criminal Mischief Attorney
Our Cincinnati Criminal Defense Attorneys Can Help
Criminal mischief is a broad offense. If you or a loved one has been accused of this crime, it is important that you seek trusted counsel through this time. Under O.R.C. 2909.07, charges can be filed against individuals for causing property damage/destruction. Further, aggravating factors may increase the extent of the penalties carried by such charges. While typically a misdemeanor, criminal mischief charges can be elevated to a felony in some cases.
You could be facing jail time, fines, and other serious penalties if you have been arrested for criminal mischief. The good news is that you are not alone. Our Cincinnati criminal mischief attorneys are former prosecutors with decades of collective experience. We know what to expect in such cases and can guide you through this time.

Penalties for Criminal Mischief Convictions
If criminal mischief results in injury or a risk of injury to others, it is considered a first-degree misdemeanor. Should personal property—such as computers—be tampered with, it can result in significant time in jail as a first-degree misdemeanor and other penalties depending on the damage caused to the individuals involved.
In cases where aircraft, parts, or cargo are tampered with resulting in the risk of harm to others, it may be considered a fifth-degree felony. Likewise, should the act be committed when the aircraft is occupied, it can be a fourth-degree felony.
- The penalties can include the following:
- First-degree misdemeanor – Up to six months in jail and potential fines
- Fifth-degree felony – Between 6 and 12 months of incarceration and fines
- Fourth-degree felony – Up to 18 months in prison and additional fines
