Joseph Patituce secured a major appellate victory in a serious sex crimes case involving three rape convictions and two gross sexual imposition convictions. The 5th District Court of Appeals reversed the two gross sexual imposition convictions outright and entered judgments of acquittal, meaning our client cannot be retried on those charges. The Court also reversed the three rape convictions after finding that the jury improperly heard evidence about our client’s decision to hire an attorney and exercise his right to remain silent, remanding those charges for a new trial.
