We often receive phone calls from individuals seeking guidance after a recent DUI arrest in the Cleveland, Ohio area. Many of these individuals have been told one of two things that are completely misleading – regardless of the source.
The first is that DUI charges are impossible to beat, the second is that they were able to get the judge to reduce the charge to a reckless operation.
DUI Charges: Myth #1
The first myth is easy enough to workaround. If you have a DUI attorney that knows what they are doing and has actual experience defending against DUI charges you can quickly see how these charges can be beaten.
For example, in a recent case, we took a look at all the breath tests performed by a specific machine in a local suburb outside of Cleveland. Our analysis of all 100+ tests revealed that the month prior to our client’s test the machine committed two errors in a row that would have required it to be taken offline, repaired, re-certified, and then placed back into service. Because the police officers did not take these steps we were able to have the breath test thrown out and our client avoided a conviction for her OVI charge.
DUI Charges: Myth #2
The second myth is more difficult to work with. Everyone has a friend that claims they went in and told their case to the judge and then the judge dismissed or reduced their charges. To be clear… if you are charged with a DUI and you plea no-contest or guilty you will be convicted of the crime.
What is worse is after you are convicted you face substantial penalties such as jail (up to six months on a first offense), the loss of your license (up to 3 years on a first offense), a large fine (up to $1075.00 on a first offense plus court costs), and the possibility that you would be required to obtain special plates. It is important that before you enter a plea of guilty or no-contest you talk to counsel that knows how to defend these cases.
